1. The Service

Arkhein provides a cloud-native application protection platform that maps, secures and monitors multi-cloud environments. Features, limits and pricing are described on our website and in the order or agreement applicable to your subscription.

2. Accounts

Access to the platform is provisioned to authorised users. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of any unauthorised use.

3. Acceptable use

• Do not use the Service unlawfully or to infringe the rights of others.
• Do not attempt to disrupt, reverse-engineer or gain unauthorised access to the Service.
• Only connect cloud accounts and run assessments that you own or are explicitly authorised to test.

4. Subscriptions & billing

Paid plans are billed according to the order you agree to. Unless stated otherwise, fees are non-refundable and subscriptions renew for successive terms until cancelled in accordance with your agreement.

5. Customer data & security

You retain all rights to your data. We access your connected cloud environments on a read-only basis to provide the Service and process your data in accordance with our Privacy Policy and any data processing agreement in place.

6. Intellectual property

The Service, including its software, content and trademarks, is owned by Arkhein and its licensors. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription.

7. Confidentiality

Each party will protect the other's confidential information and use it only as needed to perform under these Terms.

8. Warranties & disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Arkhein is a security tool and does not guarantee that all vulnerabilities or threats will be detected or prevented.

9. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental or consequential damages, and our aggregate liability will not exceed the fees paid for the Service in the twelve months preceding the claim.

10. Termination

Either party may terminate for material breach that remains uncured after a reasonable notice period. On termination, your right to use the Service ends and we will handle your data as described in the Privacy Policy and any applicable agreement.

11. Governing law

These Terms are governed by the laws applicable at Arkhein's place of establishment, without regard to conflict-of-law rules. The specific jurisdiction may be set out in your order or agreement.

12. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
